AI Album Cover Generator - Privacy & TOS

These Terms of Service and Privacy Policy explain the rules for using the Album Cover app (the "App") and how we collect, use and protect your information. The App is made by Lyndl ("we", "our" or "us") and is available on iOS and Android.
1. Acceptance of These Terms
By downloading, installing or using the App, you agree to these Terms and this Privacy Policy. If you do not agree, do not use the App.
2. Age Requirements
The App is intended for people aged 13 and older. If you are under 18, you must have permission from a parent or legal guardian. We do not knowingly collect personal information from children under 13. If you believe a child under 13 has used the App, contact us and we will delete any related data we hold.
3. What the App Does
The App uses artificial intelligence (AI) to create and edit artwork from photos you choose. Its features are:
- Album Cover: turns your photo into album cover artwork in a style you pick, with optional artist name, album title and instructions.
- Promo/Story: turns one of your album covers into a 9:16 promo image, optionally with a call-to-action badge (such as Pre-Save or Out Now) and a release date.
- YT Thumbnail: turns one of your album covers into a 16:9 YouTube thumbnail.
- Remix: creates an upgraded version of an existing cover you pick from your photos.
- AI Edit: changes a generated image based on instructions you type.
- Custom Styles: creates a reusable style from a reference image you choose.
- Editor: adds textures, contrast, sharpening and a Parental Advisory label to your images. This happens on your device.
- Upscale: increases the resolution of an image (square covers to 3000 x 3000 pixels).
- Model choice: for album covers you can choose Model 1.5 or Model 2.0. Each uses a different AI model from the providers listed in section 6.
Generated images are saved on your device, and you can save them to your photo library. Some features require a paid subscription (see section 8).
4. Information We Collect and How We Use It
We collect only what the App needs to work. We do not sell your data, show ads, or track you across other apps or websites.
- Device identifier: an anonymous ID (the iOS Identifier for Vendor or a randomly generated ID). We use it to manage your credits and subscription. It is stored on your device and in our backend.
- Photos and instructions: when you generate, edit, remix or upscale, the photo and any text you entered (style, artist name, album title, instructions) are sent through our backend to the AI providers in section 6 to create your image. We do not keep your photos on our servers after the request is done.
- Content on your device: generated images, edits, favourites, styles and preferences are stored only on your device.
- Subscription data: purchases are handled by Apple, Google Play and RevenueCat. We receive your subscription status, not your payment details.
- Credit usage: we record credit grants and usage so your balance is correct and we can help with support.
- Reports: if you report an image, we receive what is described in section 7.
- Support emails: if you contact us, we receive your email address and whatever you write.
We use this information to provide and improve the App, process your image requests, manage credits and subscriptions, review reports, provide support, and meet legal obligations.
5. Face Data
Photos you upload may show your face or other people's faces. We use these photos only to create the artwork you ask for, for example so the person in your photo still looks like themselves on the cover.
- No face data is collected or stored by us. We do not extract, measure or store facial features, face geometry, faceprints or any other biometric identifiers.
- No identification or profiling. Photos are never used to identify, recognise, authenticate or track anyone, to build profiles, for advertising or marketing, or to train our own AI models.
- No selling. We never sell or rent photos or anything derived from them.
- Who receives them: a photo is shared only with the AI providers in section 6, only to generate or edit your image, and only after you allow AI processing (section 7).
- How long it is kept: we do not keep your photos on our servers after the request is done. The AI providers process them temporarily under their own privacy policies. Generated images stay on your device until you delete them.
- Custom styles: when you create a custom style, the reference image is analysed by Google Gemini to describe its visual style (colours, lighting, composition, typography). It is not used to identify anyone.
6. Third-Party Services
These services help run the App. Each processes data under its own privacy policy.
- Replicate: runs the AI models that generate, edit and upscale images. Receives your photo and instructions.
- fal.ai: backup AI provider, used only if Replicate is unavailable. Receives your photo and instructions.
- Google: its Gemini models power Model 1.5 and custom style analysis. Receives your photo and instructions (through Replicate or fal.ai) and custom style reference images.
- OpenAI: its GPT Image model powers Model 2.0, AI Edit, Promo/Story, YT Thumbnail and Remix. Receives your photo and instructions (through Replicate or fal.ai).
- Supabase: our backend for credits, device identifiers, reports, and passing requests to the AI providers. Receives your device identifier, credit records and reports.
- RevenueCat: manages subscriptions and purchases. Receives your device identifier and purchase status.
- Apple and Google Play: app distribution and payments, under their own terms.
7. Permissions, Storage and Retention
AI processing consent: before any photo or instruction is sent to an AI provider, the App asks for your permission and names the providers (Replicate, fal.ai, Google and OpenAI). If you decline, nothing is sent and the AI features will not work. You can still use the editor on images already on your device.
Photo library: the App asks for access so you can pick photos to use and save finished images. It only reads a photo when you pick it. You can change this anytime in your device settings.
Where data is stored:
- On your device: generated images, edit settings, previews, favourites, custom styles and preferences. Deleting the App deletes them.
- On our backend (Supabase): your device identifier, credit records and any reports you send.
- Photos and instructions are not stored on our servers. AI providers process them temporarily under their own policies.
Reports: if you report an image, we receive your description of the problem, a small copy of the reported image, its format (for example, Promo/Story), your device identifier, the App version and your platform. We use reports only to review the content and improve our safeguards.
How long we keep data:
- Device identifier and credit records: while you use the App, and as long as needed for accounting and legal obligations.
- Reports: up to 12 months, or longer if needed to handle abuse or meet legal obligations.
- Support emails: as long as needed to resolve your request.
We use industry-standard security measures to protect the data we hold.
8. Purchases, Credits, Commercial Use and Refunds
Subscriptions and credit packs: the App offers Weekly and Monthly subscriptions and one-time credit packs, sold through Apple's In-App Purchase or Google Play billing. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel them in your Apple ID or Google Play account settings.
Credits: each successful generation uses one credit, including AI Edits, Promo/Story, YT Thumbnail and Remix images. A request that fails does not use a credit. Subscriptions include credits for each billing period. Promo/Story, YT Thumbnail, Remix and Upscale require an active subscription.
Refunds: refunds are handled by Apple or Google under their refund policies. Contact them to request a refund.
Commercial use: you may use artwork commercially only if it was created under an active paid subscription, paid purchase or other paid commercial license from us.
- Artwork created with free generations, free credits, trials or promotional credits is for personal, non-commercial use only. It may not be used for advertising, promotion, branding, merchandise, sales, streaming releases, distribution, resale, monetised content or any other commercial purpose.
- If you receive a refund, chargeback or payment reversal for a purchase that granted commercial rights, the commercial license for artwork tied to that purchase ends immediately. This applies even if the artwork was already downloaded, published, distributed or sold.
- After such a refund or reversal, you must stop all commercial use of that artwork unless you obtain a new paid commercial license from us.
9. Acceptable Use and Prohibited Uses
You are responsible for the photos you upload, the instructions you write and how you use what the App creates. You may only upload photos you have the right to use. You agree not to:
- Create sexual, nude or intimate imagery of any real person, or any sexual imagery involving minors.
- Upload or edit a photo of another person without their consent, or use the App to impersonate, harass, bully, deceive or embarrass anyone, including by creating misleading "deepfake" images.
- Generate illegal, hateful, violent, harmful or otherwise offensive content.
- Infringe anyone's intellectual property, trademark, privacy or publicity rights.
- Reverse engineer, modify or interfere with the App or its backend, or use bots or automated systems to access or abuse the service.
- Use artwork from free generations, free credits, trials or promotional credits for commercial purposes, or keep using artwork commercially after its paid commercial license was refunded, revoked, cancelled or otherwise invalidated.
Our AI providers apply their own safety filters and may refuse requests. We may limit or block access for devices that break these rules.
10. Reporting Content
AI can make mistakes. If an image looks offensive, harmful or inappropriate, tap Report on the image's edit page and tell us what is wrong. We review every report and use it to improve our safeguards. You can also email us at the address in section 14.
11. Your Rights
You can ask us to give you, or delete, the data we hold about your device (device identifier, credit records and reports). Images on your device are yours to export or delete at any time. Depending on where you live, you may have more rights under local law. To make a request, contact us using the details in section 14.
12. Limitation of Liability
The App is provided "as is" without warranties of any kind, express or implied. We are not liable for damages arising from your use of the App or of generated content. AI-generated artwork may not be unique, may not be available for trademark registration and may be subject to third-party claims. You are responsible for checking that your intended use, including commercial use, is legally permitted.
13. Changes to These Terms
We may update these Terms and Privacy Policy from time to time. We will show the new "last updated" date on this page and notify you in the App or by email where required. Continuing to use the App after a change means you accept the updated Terms.
