AI Album Cover Generator ("we," "our," or "us") provides this Terms of Service and Privacy Policy to explain how we collect, use, and protect your information when you use our iOS application (the "App").
1. Acceptance of Terms
By downloading, installing, or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.
2. Age Restrictions
The App is intended for users aged 13 and older. Users under 18 must have parental or guardian consent. We do not knowingly collect personal information from children under 13.
3. Description of Service
The App uses artificial intelligence to generate album cover artwork from images you upload. You can select styles, add text such as artist names or album titles, and save generated images to your device.
4. Data Collection and Use
Information We Collect
Device Information: We collect an anonymous device identifier, using iOS Identifier for Vendor or a randomly generated ID, to manage your credits and subscription status. This identifier is stored securely on your device and in our backend systems.
Images: When you upload images, they are processed by third party AI services, including Replicate, to generate album covers. Images are temporarily processed during generation and are not stored by us after processing completes, except as necessary to provide the service.
User Content: Information you provide, including artist names, album titles, custom prompts, and style preferences, is stored locally on your device. This information is not transmitted to our servers except as part of the image generation process.
Subscription Data: If you purchase a subscription, payment and subscription information is handled by Apple and RevenueCat in accordance with their privacy policies. We receive anonymized subscription status information to manage your account credits and features.
Usage Data: We track credit usage and feature access to manage your subscription and provide customer support.
How We Use Your Data
We use your data:
- To provide and improve the App's functionality
- To manage your credits and subscription
- To process image generation requests
- To provide customer support
- To comply with legal obligations
5. Third Party Services
The App uses the following third party services:
- Supabase backend infrastructure for managing credits and device identifiers
- Replicate AI image generation service. Your uploaded images are sent to Replicate for processing
- RevenueCat subscription management service
- Apple payment processing and App Store services
6. Photo Library Access
The App requests access to your photo library to allow you to select images for album cover generation and save generated album covers to your device. You can revoke this permission at any time in your iOS Settings. Images are only accessed when you choose to upload or save them.

8. In App Purchases, Commercial Use, and Refunds
The App offers subscription plans such as Weekly, Monthly, and Annual through Apple's In App Purchase system. All purchases are processed by Apple and subject to Apple's Terms of Service. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage subscriptions in your Apple ID account settings.
Refund Policy: Refunds are handled by Apple in accordance with Apple's refund policy. Contact Apple Support for refund requests.
Commercial Use License: Commercial use of generated artwork is permitted only if the artwork was created under an active paid subscription, paid purchase, or other paid commercial license offered by us. Artwork created through free generations, free credits, trial access, promotional credits, or any other unpaid use of the App is not licensed for commercial use.
No Commercial Use for Free Generations: Any artwork generated without payment is for personal, non-commercial use only. Free generations may not be used for advertising, promotion, branding, merchandise, sales, streaming releases, distribution, resale, monetized content, or any other commercial purpose.
Effect of Refunds on Commercial Rights: If you receive a refund, chargeback, payment reversal, or similar reimbursement for any purchase, subscription, or license that granted commercial use rights, your commercial license for artwork associated with that purchase is immediately revoked upon the refund or reversal being issued.
Used Artwork After Payment, Then Requested Refund: If you paid for commercial rights, used the artwork, and then requested or received a refund, you lose access to the commercial license for that artwork. This applies even if the artwork was already downloaded, exported, published, distributed, marketed, sold, or otherwise used before the refund was requested or issued.
Obligation to Stop Commercial Use: After a refund, chargeback, or payment reversal, you must immediately stop all commercial use of any affected artwork unless you later obtain a new valid paid commercial license from us.

You have the right to:
- Access your data stored on our servers
- Request deletion of your data
- Opt out of data collection, though this may limit App functionality
- Export your generated images stored locally

11. Prohibited Uses
You agree not to:
- Use the App to generate illegal, harmful, or offensive content
- Violate intellectual property rights
- Attempt to reverse engineer or modify the App
- Use automated systems to abuse the service
- Use any artwork generated through free generations, free credits, trial access, promotional credits, or other unpaid access for commercial purposes
- Continue using artwork for commercial purposes after the related paid commercial license has been refunded, revoked, cancelled, terminated, or otherwise invalidated
12. Limitation of Liability
The App is provided "as is" without warranties of any kind, whether express or implied. We are not liable for damages arising from your use of the App or generated content. You are solely responsible for ensuring that you have the rights to use any uploaded images and that your use of generated content complies with applicable laws, regulations, platform rules, and third party rights.
We do not guarantee that any generated artwork is unique, available for trademark use, or free from third party claims. You are responsible for determining whether your intended use, including commercial use, is legally permitted.
13. Changes to Terms
We may update these Terms and Privacy Policy from time to time. Material changes will be notified through the App or via email where required. Continued use of the App after changes become effective constitutes acceptance of the updated Terms.
